Employers can legally drug – or alcohol – test their employees if they have an agreed workplace policy that allows for such testing. As with all aspects of a substance use framework, testing for alcohol and/or drugs has positive and negative potential – it can be divisive and counterproductive, or it can positively impact aspects of your business.
Testing must occur in accordance with the terms and conditions of the policy, and the terms must be fair and reasonable, otherwise legal challenges could arise.
Testing can be conducted at the following times:
- For reasonable cause/suspicion
- Post accident
- Return to work (after a positive result)
- Annual medical
Alcohol and other drug use outside work hours can manifest at work, with effects potentially present for several days after use. Although someone can be affected several days after use, drug testing is not guaranteed to detect this.
